Terms of Service & Acceptable Use Policy

Governing the use of Lokam's conversational AI voice and messaging platform, media servers, and API gateways.

1. Acceptance of Terms

By creating an account on app.lokam.si, utilizing our REST API, or deploying embeddable web chat widgets, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an enterprise or organization, you represent that you have legal authority to bind that entity.

2. Acceptable Use Policy (AUP) & Telecommunications Compliance

Customers must comply with all national and international telecommunications regulations (including TCPA in the US, TSR, STIR/SHAKEN caller ID authentication, and EU ePrivacy Directive):

  • Prohibition on Robocall Abuse: You may not use Lokam to conduct unsolicited telemarketing, deceptive voice phishing (vishing), spoofed caller IDs, or automated spam dialing without prior verifiable consent.
  • Emergency Calling (E911): Lokam conversational agents are NOT a replacement for emergency service calling (911/112). You agree not to configure agents as primary emergency response dispatchers.
  • WhatsApp Business Compliance: All messaging campaigns must adhere strictly to Meta's WhatsApp Commerce and Business Policies.

3. Subscription, Quotas, and Overages

Plans are billed either monthly or annually in advance according to your selected tier (Starter, Professional, Growth, Enterprise). Usage exceeding included monthly voice minutes or WhatsApp chat sessions will incur overage charges at $0.08 per additional voice minute and $0.02 per additional chat session, billed in arrears.

4. Intellectual Property & Workflow Ownership

You retain 100% ownership of your visual flow graphs, system prompts, knowledge base training documents, and customer databases. Lokam claims zero intellectual property rights over the conversational workflows you construct within the platform.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Lokam Technologies Inc. shall not be liable for indirect, incidental, or consequential damages resulting from telecom carrier outages, upstream LLM provider API interruptions, or unauthorized access resulting from compromised customer API keys.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
